Purchase Agreement & Health Contract

Heaven Bound Labradors take pride in producing quality Labrador Retriever puppies. We take extra precautions before breeding to ensure our puppies are born healthy and free of genetic diseases. All our breeding Labrador Retrievers have had an OFA evaluation on hips and elbows, as well as genetically tested and proven clear of CNM, DM, EIC, PRA, PRCD, RD, SD, HPNK, and do not carry the dilute gene. This testing ensures our puppies will never be affected by hereditary or genetic diseases common in Labradors.

Initial Health Guarantee

The puppy you purchase from Heaven Bound Labradors is guaranteed to be in good health at the time of sale, with the first vaccine and a series of deworming given as deemed necessary. Good health is defined in this guarantee as free of serious illness or genetic defects that will shorten your dog's life.

Heaven Bound Labradors reserves the right to have the puppy examined by a licensed veterinarian of its choice at our expense. Should there be a discrepancy between the Buyer's and our licensed veterinarian's findings, our veterinary findings shall take precedence. If the puppy is deemed not in good health by Heaven Bound Labradors, the original puppy will be replaced with a comparable puppy of the same value as the first available litter. Should the above terms not be met, the initial Health Guarantee will be held void. Serious illness and life-altering defects do not include umbilical hernia, external or internal parasites or bacteria, coccidiosis, giardia, undescended testicles, inverted vulva, underbite, or overbite, skin allergies, skin irritations or hair loss. The preceding list of illnesses and defects is not exhaustive. Furthermore, Heaven Bound Labradors does not guarantee or warranty the puppy's size, color, personality, disposition, or trainability. However, we take great pride in ensuring your puppy has been well-socialized and introduced to many sights, textures, and sounds before going to his/her new home.

Genetic Health Contract

The puppy you purchase is guaranteed to be in good health and free of life-threatening genetic illnesses resulting in death. Should your puppy die from a life-threatening genetic illness, the puppy will be replaced with a comparable puppy of the same value as the first available litter. A licensed veterinarian must determine the cause of death. It is up to the Buyer to provide evidence that the cause of death was genetic. Upon finding by a licensed veterinarian that a genetic defect caused the puppy's death, the Buyer must notify Heaven Bound Labradors within 24 hours. In addition, all the dog's vet records must be sent to Heaven Bound Labradors' veterinarian for his/her opinion to determine the cause of death. Should there be a discrepancy between the Buyer's and Heaven Bound Labrador's licensed veterinarian findings, Heaven Bound Labrador's veterinary findings shall take precedence. The Genetic Health Guarantee will be held void if the above terms are not met. This genetic health guarantee does not cover if the puppy is a carrier of a genetic disease because being a carrier of a genetic disease will not directly impact the health or life expectancy of the purchased puppy.

4-year Health Guarantee

Heaven Bound Labradors guarantees all the puppies we produce will be free from moderate to severe hereditary hip dysplasia and hereditary retinal eye disease. Because poor nutrition has been related to dysplasia, your puppy must continue with the NuVet Plus supplements and NuJoint Plus for the first 48 months. We recommend remaining on Life’s Abundance dog food. Should the dog be found to have moderate to severe hereditary hip dysplasia or hereditary eye defects within 48 months, Heaven Bound Labradors will replace the puppy with a puppy of equal value when one becomes available. Under no circumstances will a cash refund be given. The puppy MUST be allowed to develop before stressing the dog's joints, and as such, for the guarantee to be valid, the puppy must not be allowed to become obese or underweight. The puppy must not have suffered any trauma before the exam. The puppy must be given exercise, yet not excessively. The buyer agrees not to start agility, heavy or competitive field training, or any activity which may damage the puppy’s bone or muscle structure until he/she has reached a minimum of 24 months of age (the puppy needs to reach a physical maturity level which will allow such activities not to damage the animal). A replacement puppy will NOT be given if the prior puppy was not adequately taken care of and all aspects of this contract were not met.

Limitations

Although we have done everything we can to prevent these things, parasites, coccidiosis, mites, skin infections, fungal infections, hair loss, and giardia are common problems in animals, especially young puppies, and can be treated; therefore, these are excluded from this guarantee. This guarantee does not cover mistreatment of the puppy, injury, accidents, poisoning, etc., if the dog is overweight, underweight, and has not been used in agility, running, jumping, or over-exercised during their growth period of 24 months during the period of guarantee. It does not cover trauma-related or environmental factors that adversely affect the dog. Heaven Bound Labradors does not guarantee your dog's hips against any form of dysplasia attributable to non-genetic causes. If the dog is bred before two years of age, this contract is no longer in effect. This guarantee does not cover if the puppy is a carrier of a genetic disease because being a carrier of a genetic disease will not directly impact the health or life expectancy of the purchased puppy. If the puppy is used to reproduce offspring, the Buyer must perform the appropriate genetic tests before mating occurs. Heaven Bound Labradors are not responsible for the genetic health of your puppy's offspring.

Buyer's Responsibilities

It is the responsibility of the Buyer to register their puppy with AKC within seven days of the date buyer received their puppy. The buyer is responsible for adequately providing what is needed to maintain a healthy dog. To ensure optimal health and growth, the Buyer must continue Life’s Abundance Nutritional System, NuJoint Plus supplements. The buyer agrees to give adequate training and socializing to the puppy/dog. The Buyer agrees to give the puppy a clean and safe environment.

Also, it is noted that Heaven Bound Labradors doesn't take responsibility for this puppy/dog once it has left the premises. This includes veterinary medical expenses, mortality, landlord’s disapproval, allergic reaction to the puppy, family disagreement, behavioral / training difficulties, mistreatment of puppy/dog, accidental poisoning or trauma, or any other reason not explicitly stated above. The Buyer agrees to offer Heaven Bound Labradors the first chance to get this puppy/dog back and have papers transferred back into Heaven Bound Labradors’ name. In the event of a resale, the Buyer must notify Heaven Bound Labradors of the name and address of the new owner. The buyer also agrees not to sell this puppy/dog to any breeding program, retail company, or establishment or donate it to any animal shelter or pound. The buyer will be responsible for all transportation costs, and no refunds will be issued for the puppy/dog.

Closing

This contract applies only to the original buyer and is not transferable. If the buyer violates any part of this contract, all guarantees made by the seller in both the Health Guarantee and this contract become VOID immediately. Furthermore, any legal action or litigation is to be in the county of Franklin County, TX, or the seller’s/breeder’s residence at the time of the claim. All the seller’s/breeder’s attorney expenses are the buyer's responsibility if the seller/breeder is not at fault.

We have read the details of this contract and fully understand what I have read. I agree to abide by the conditions of this contract, and if I do not comply with said contract, I understand that the health guarantee from the breeder may be VOID, and/or I may be held responsible for damages owed to the breeder. I also understand that I agree to the terms outlined in this contract by submitting a deposit to Heaven Bound Labradors and/or signing this contract electronically or by hand.
